The legal situation for igaming and betting companies differs from country to country. In some countries there are very few laws and regulations, while in other countries there are very strict laws to be followed. Somehow, igaming companies need to operate in this changing landscape and be compliant with any and all laws. This means that all igaming operatos will have a Compliance Department and staff whose job is to track the legal changes and the company’s processes to ensure that it operates within the law.

What is a compliance manager?

An igaming operator will have a team of staff that ensure their company remains within the laws of any jurisdictions that it operates in. This department will have a Head of Compliance that will have a seat on the Board of Directors. There is a legal requirement for this in most jurisdictions, though the role is often called the Responsible Person. The Head of Compliance will have a purely managerial role. Often this person will have a background as a lawyer.

Underneath the Head of Compliance will be a Compliance Manager. This person will be an expert in the laws of at least one jurisdiction that the company operates in. They will work closely with the rest of the company – especially the marketing and customer service departments. Below the Compliance Manager will be several Compliance Officers. These members of staff will also be responsible for working closely with rest of the company, setting policies for HR and doing the day to day work of igaming compliance.

The reality is that most igaming businesses are very entrepreneurial and fast moving. This often leads to a culture where staff promote the business in almost any way they like. While it can be fun to be this creative, the reality is that in some countries this just is not allowed. Governments, such as in the UK, have a history of imposing serious fines on businesses that have clearly breached the law. For this reason, the Compliance Department spends time looking at individual advertisements to ensure their compliance. This means that they have to work closely with country managers, CRM teams and others in the marketing department.

There will also be many situations where a customer has queried something or complained about an issue and it might not be clear exactly what ought to be done. In these circumstances the compliance department will help to ensure that the issue is resolved and that it is done so compliantly.

What are responsible gaming staff?

iGaming businesses also have very clear responsibilities relating to player protection. In countries that are regulated, businesses have to ensure that players showing the signs of harmful behaviour are identified and prevented from gambling any further. These policies need to be written and all staff, but especially customer service staff, must be trained to ensure that they understand the rules and will enforce them seriously. For these reasons, any operator in regulated countries will have one or more responsible gaming staff to ensure compliance with these laws.

What about GDPR?

Since 2017 all businesses in Europe have to comply with much stricter data protection laws, known as GDPR. Many igaming operators employed a Data Protection Officer whose job was to ensure that the company had sound processes and technology to protect both client and company information.
GDPR is a much more complex and demanding set of legislation with much higher potential penalties for non-compliance. These high potential fines made all igaming operators based in Malta look closely at the law and change or improve their Terms and Conditions, Privacy Policies, processes and technology. Since compliance is very important, many companies chose to send one or more members of staff on specialised GDPR training courses. Staff with a legal background and GDPR training have been in high demand in Malta.

How much do compliance staff earn in igaming?

As you can guess, a Head of Compliance that has a seat on the Board of Directors will earn a substantial salary and have excellent job security. There are relatively few of these people because at most there can only be one such role per company.
Each company will have it’s own structure, for some this role will be Head of Legal or General Counsel. Whatever this role may be, it is likely to have a six figure salary.
Salary ranges for other staff will depend upon the level of experience and qualifications that the applicant has. Junior roles are likely to start at just under €30,000 per year and more senior roles requiring specific qualifications and experience might be paid as high as €75,000 per year.
